Privacy Policy for BirthnDay (Beta)

This Privacy Policy (the "Policy") explains what information may be collected and how it is used when you use the BirthnDay website and related services (the "Service").

By using the Service, you acknowledge that you have read this Policy. If you do not agree, please do not use the Service.

1. What BirthnDay Is and How the Service Works

BirthnDay is an online showcase (directory) of service providers and services for celebrations and events (for example: planners, decor, photo/video, venues, gifts, etc.), as well as a software platform that provides tools for planning personal events.

The Service helps users:

  • discover service providers via the website, directory, collections, and other display formats;

  • view cards, portfolios, contact information, service descriptions, and budget guidelines;

  • plan personal events using Platform tools;

  • contact service providers directly using the contact information they provide.

BirthnDay is in a beta-testing phase: the interface, display logic, and functionality may change, and certain features may be temporarily unavailable.

2. Information We May Collect

We aim to collect only the minimum information necessary to operate the Service and communicate with users.

2.1 Information You Provide - Categories of personal data we collect may include:

  • identifiers: name or project name, email, phone or messaging details (if provided voluntarily);

  • location and operational details: city, languages, availability;

  • commercial information: service descriptions and pricing guidelines;

  • internet or electronic activity links: website and social media links;

  • visual and audio content: photos, videos, logos, text, and portfolios.

    2.2 Information Collected Automatically - Categories of data collected automatically may include:

  • usage data: pages viewed, interactions, timestamps;

    2.3 Payments (If Applicable) - Payments may be processed via third-party payment providers. BirthnDay does not collect or store full payment card details. We may receive limited transaction data (e.g., status, date, amount, payer email) for operational purposes.

3. How We Use the Data

We use information to:

  • create and display user profiles and listings;
  • display authorized contact and profile information;
  • communicate with users;
  • operate, maintain, and secure the Service;
  • improve functionality and user experience;
  • comply with legal obligations, enforce our Terms of Use, and protect rights and safety.

4. Public Profile and Materials

If you participate as a service provider, certain information may be publicly visible, including: name, description, images, links, location, and contact information (as provided and approved by you).

We may use submitted materials for profile creation and formatting, collections and recommendations, and BirthnDay content and promotional materials, provided such use is contextually appropriate and does not reasonably harm your reputation. We will not use your materials in a manner that misrepresents your services or harms your professional reputation.

Public materials may appear within Platform features such as collections or user-generated lists. This does not transfer ownership rights or grant third parties rights to use such materials outside the Platform without permission.

5. Cookies and Similar Technologies

We may use cookies to operate and secure the Service, prevent abuse, and store basic preferences.

Analytics (Future Use) - We may implement third-party analytics tools in the future to understand usage and improve the Service. If such tools materially change data processing, this Policy will be updated. Prior to enabling any third-party analytics or tracking tools, we will implement an appropriate consent mechanism in accordance with applicable law.

Managing Cookies - You may control cookies via browser settings. Disabling cookies may affect functionality.

Do Not Track (DNT) - We do not guarantee consistent responses to DNT signals.

We do not sell personal data and do not share it for cross-context behavioral advertising.

We use reasonable safeguards to protect your data. However, no method of transmission over the Internet or method of electronic storage is completely secure. Users should avoid sharing sensitive data unnecessarily.

The Service is intended for users 18 years of age or older. By using the Service, you confirm that you meet this requirement. If we become aware that a user does not meet this requirement, we will take appropriate steps to remove their access and data.

BirthnDay does not sell personal data or share it for cross-context behavioral advertising as defined under California law.

12. Changes to This Policy

We may update this Policy. The latest version will always include an updated effective date. If changes are significant, we will make reasonable efforts to notify users via the Service or by email.

13. Legal Basis for Processing

We process personal data based on our legitimate interests in operating and improving the Service and fulfilling our contractual obligations to users. Where required by applicable law, we will rely on additional legal bases such as consent.
